Triple Talaq: Supreme Court Says Will Focus Only on 'Legal' Aspects

Supreme Court will soon examine the legal aspects of Triple Talaq – a practice by Muslim men to get divorce by pronouncing Talaq three times.

The Supreme Court bench including Chief Justice JS Khehar and Justices NV Ramana and DY Chandrachud has asked the legal advisors from both sides, All India Muslim Personal Law Board and others resisting triple talaq – to propose the issues to be inspected by the Supreme court . The Supreme Court said it would just choose issues relating to “legal” parts of the acts of triple talaq and polygamy among Muslims . It would stay clear from whether getting divorce under Muslim law should be regulated by courts as it falls under the legal realm.

“We are not fascinated with actualities (of individual cases) by any means. We are just absorbing by managing the lawful issue,” the bench said. SC has permitted the legal counsellors to file a summation of cases relating to ladies who had gone through it.

The Supreme court said the hearings would start on May 11 and will be finished within seven days.The personal law board had earlier claimed that Muslim practices, for example, polygamy and triple talaq were matters of ” legal policy”.

The Supreme Court is hearing a collection of petitions exacting triple talaq, with women complaining that they have even been divorced by means of Facebook and WhatsApp and other social media. The (NDA) National Democratic Alliance government says triple talaq disregards the principal rights ensured by the Constitution.
